This is no investigation, Lawyer says on Matiang'i grilling

Lawyer Otiende Amollo has said investigators at DCI offices have only engaged the team representing former CS Fred Matiangí for 15 minutes. 

Amollo said the battery of lawyers that had accompanied Matiangí to the officers were kept waiting for five hours. 

Taking to his Twitter account, Amollo said his team has been kept waiting, claiming there is no investigation taking place. 

"This, despite a Hight Court order! This is no investigation, pure vendetta and witch-hunt. Sad indeed!" he tweeted. 

Another lawyer, Steve Mogaka said the investigators framed their two areas of interest to which Matiang'i on the advice of his legal team invoked his constitutional right to remain silent.

“The investigation team which appeared to be receiving orders from elsewhere threatened to arrest the CS. The legal team reminded the investigators that there is a court order ( anticipatory bail/ bond) restraining any such intended arrest,” said Mogaka in a Facebook post.

He added the frustrated investigators retreated to ' consult'.

“They are determined to violate the court orders and arrest the CS. We are holed at CID HQ as required by our professional calling to ensure no violation of the rights of any citizen including but not limited to Hon. Cs Dr Fred Matiang'i. I will keep the country informed.”

Matiang'i arrived in the company of lawyers and went into an interrogation room where four senior officers from the Crime Research and Intelligence Bureau were waiting.

By mid-day, there were no signs of them getting out amid reports there were plans to charge Matiang'i.

DCI Mohamed Amin did not respond to our queries on the developments therein.

Matiang'i had earlier this morning presented himself at the DCI offices along Kiambu Road over claims of publication of false information.

His appearance follows a summons by the DCI on Monday.

The former CS was accompanied by a host of politicians including his former colleague Eugene Wamalwa.

He is accused of spreading false information about an alleged invasion of a raid in his Karen residence by a group of police officers between February 8 and 9, 2023.

Some of the charges that have been put against the former CS is that he caused the publication of false information contrary to Section 23 of the Computer Misuse and Cyber Crimes Act of 2018 among other offences.

He maintains he never talked to any public officials regarding the issue.
