Miguna defends DPP Haji over withdrawal of cases

Lawyer Miguna Miguna has defended the current wave of case withdrawals by the Director of Public Prosecutions, Noordin Haji.

He said it was the right move to seek cancellations if there was a lack of enough evidence to sustain the charges.

"There is absolutely nothing wrong for the @ODPP_KE to apply for the withdrawal/termination/discontinuation of cases they cannot win either because the evidence cannot sustain the charges, or the charges were politically-motivated," he said on Wednesday.

"Either way, DPP Haji stands indicted."

He added that charges should not be initiated against innocent people so that the criminal justice institutions can have work to do.

"Kenyans should only be charged if there is credible evidence that they have committed crimes and the evidence is sufficient to convict them," he added.

Miguna's remarks come after an uproar following the withdrawal of high-profile graft cases.

Haji on Wednesday withdrew Sh19m graft case against former Malindi MP Aisha Jumwa.

He also discontinued Sh400 million graft case against former KPLC MD Ben Chumo and 10 others.

The withdrawals sparked mixed reactions from organizations and Kenyans at large.

LSK President Eric Theuri wondered if Haji was admitting to having erred.

"Is the DPP admitting that they instituted corruption cases when they did not have evidence? Were the cases abuse of the criminal process? Is the continued prosecution against public policy? ODPP, you owe Kenyans explanations," he said.
