Lawyer Donald Kipkorir: DPP Haji should be arrested for abuse of office

Lawyer Donald Kipkorir has said the Director of Public Prosecutions Noordin Haji ought to be arrested for abuse of office.

In a statement on Wednesday, Kipkorir said the withdrawals of cases by the ODPP is an indication that his office was politically abused by the former government.

"Director of Public Prosecution is Constitutional office with the security of tenure. By withdrawing all high-profile corruption, rape, public theft and fraud cases, @ODPP_KE admits he was a flower girl to the previous government," he said.

"Noordin Haji must be arrested for political abuse of office."

On Wednesday morning, the DPP withdrew the Sh19 million graft charges against former Malindi MP Aisha Jumwa.

The former Malindi MP was accused of alleged embezzlement of CDF funds between May 14 and October 12, 2018.

A sh400 million corruption case against former Kenya Power MD Ben Chumo and 10 others was also withdrawn.

Chumo had been charged alongside Muwa Company Limited, its director, wife and son. Their case was withdrawn on March 22.

Haji had also sought to withdraw Sh84 million graft charges against former Samburu governor Moses Lenolkulal.

The court however blocked the prayer.

Magistrate Thomas Nzyuki declined to have the case withdrawn orally and at the same time directed ODPP to file a formal application.

The Law Society of Kenya (LSK) has also raised concerns over the cancellations and called on the Judiciary to get valid and reasonable explanations regarding the actions.

"Is the DPP admitting that they instituted corruption cases when they did not have evidence? Were the cases a matter of abuse of the Criminal Process? Is this the continued prosecution against public policy? ODPP, you owe Kenyans explanations," LSK President Eric Theuri said.
