A case in which the Ethics and Anti-Corruption Commission is seeking to recover Sh26 million from five former Homa Bay county officials is scheduled for hearing on Wednesday.

The five include former county assembly clerk Bob Kephas Otieno, Caroline Chepkemoi Sang (former principal finance officer), Maurice Odiwuor Amek (former principal accountant), Michael Owino Ooro (former majority leader), and Isaac Ouso Nyandege (former minority leader).

They were last year jailed for six years with an alternative fine of a cumulative Sh59 million.

That sentencing was upheld by Justice Esther Maina after the five appealed at the High Court.

Consequently, EACC instituted a recovery suit seeking to have the five convicts ordered to return the cash.

The five were found guilty of embezzling Sh27.8 million in a Homa Bay anti-corruption court by senior principal magistrate Thomas Obutu.

Justice Esther Maina dismissed them citing lack of merit.

Justice Maina said the trial court properly found them guilty of embezzlement of public funds.

After the EACC suit, Justice Maina last month ordered former clerk Bob Kephas Otieno and his wife Evelyne Ogutu to return Sh26 million reported to have been stolen by the pair from public coffers.

The ruling was delivered after investigations by the EACC established that Otieno abused his office and wired the said amount directly to the bank account of Nyangume Enterprises, a company belonging to his wife, even though it did not render any services to the county.

Some of the loot was subsequently wired to Otieno's bank accounts as per EACC findings.

The case that has been partly heard will proceed this morning.
