Kiambu resident files petition against DG Nyoro

A Kiambu resident has filed a petition against her deputy governor James Nyoro claiming he is acting in violation of his powers 

Petitioner, Marion Njoroge ,filed the suit claiming Nyoro in the past weeks has been violating article 179 (5) by exercising powers only limited to the governor.

"The 1st Respondent(Kiambu deputy governor) is basically acting in clear violation of his powers and the abuse amounts to an abuse of his office as the deputy governor,"reads the petition.

Njoroge said the DG  has purported to reshuffle, dismiss, and or to assign the executive secretaries  hence acted in excess of his powers.

She accused Nyoro of unlawfully and illegally dismissing a huge number of county enforcement officers from employment citing that the move has affected her negatively.

She wants the court to restrain Nyoro from appointing,reshuffling ,reassigning, dismissing or in any way interfering in any way whatsoever with the existing line up of  executive secretaries,chief officers,enforcement officers and or any other senior officers .

The hearing of the case will be on Tuesday at 9 am.

This comes a day after  he  withdrew  official vehicles assigned to two senior officials allied to embattled Governor Ferdinand Waititu.

They are Roads, Transport, Public Works and Energy executive Juliet Kimemia and her Finance and Planning counterpart Mr Kigo Njenga who is a former MP for Gatundu North.

 Nyoro told the Nation that he authorised the withdrawal of the vehicles and their drivers reassigned because the two were “engaging in politics instead of development” and using the county vehicles for private purposes.

He  took over the county's leadership after a court barred Kiambu governor Ferdinard Waititu from conducting county business.

Waititu was arraigned on July  alongside his wife Susan Wangari Ndung’u linked to a Sh588 million tender scam.

He denied charges and the case against him is  to be determined.

 

In August his deputy met all elected leaders in the county to strengthen unity that dissipated after the arrest of  Waititu.

Nyoro said he had started streamlining the functions to being transparent and accountable in the use of revenue.

"We have wasted two years fighting and wrangling over petty issues with the governor," he said.
