Mombasa court allows EACC to reclaim Sh150m grabbed KBC land

The Ethics and Anti-Corruption Commission (EACC) has been granted orders to preserve public land worth Sh150 million allegedly grabbed from the Kenya Broadcasting Corporation.

Justice Nelly Matheka granted the orders pending hearing of the recovery case in Mombasa.

EACC in a statement on Saturday said the land had been reserved for the extension of the then VoK.

EACC now wants the court to declare that all the transactions relating to the allocation and sub-division of the KBC land fraudulent, illegal, null and void, and incapable of passing any lawful right, title, or interest over the property to the Defendants or any other person.

In the suit, EACC has sued two individuals and their company which is alleged to have been fraudulently allocated the land a former commissioner of lands.

According to EACC, the former commissioner is sued in his personal capacity on account of fraud, illegality, and acting beyond his powers.

“Owing to his conduct, the KBC property has been illegally put to private use and rendered unavailable for the intended public purpose,” EACC said.

This comes barely two days after the commission secured other orders from the Environment and Land Court in Mombasa to preserve a parcel of land grabbed from public land set aside as a road reserve.

The land is currently used as a parking space for Nairobi University Mombasa Campus.

The parcel measures approximately 0.0542 hectares and is currently valued at Sh21 million.

The property was allegedly fraudulently, irregularly and unlawfully allocated to a Councilor at Mombasa Municipal Council.

In the suit filed by EACC on May 29, 2023, the Commission sued three people.

The University of Nairobi and the County Government of Mombasa are listed as interested parties.
