EACC okayed to reclaim Sh21m grabbed land in Mombasa

The Ethics and Anti-Corruption Commission has secured orders from the Environment and Land Court in Mombasa to preserve a parcel of land grabbed from public land set aside as a road reserve.

The land is currently used as a parking space for Nairobi University Mombasa Campus.

The parcel measures approximately 0.0542 hectares and is currently valued at Sh21 million.

The property was allegedly fraudulently, irregularly and unlawfully allocated to a Councilor at Mombasa Municipal Council.

In the suit filed by EACC on May 29, 2023, the Commission sued three people.

The University of Nairobi and the County Government of Mombasa are listed as interested parties.

The court orders issued by Lady Justice Nelly Matheka of the Mombasa Environment and Land Court prohibited the administrator of the alleged grabbed property, whether by himself or through his agents, servants or assigns from alienating, transferring or undertaking any construction or development in the land.

EACC said the entire stretch of Machakos Road, adjacent to the UoN Mombasa Campus is grabbed.

The illegal owners are said to have undertaken commercial developments.

"We are finalizing investigations and filing of suits to recover the additional parcels to revert to the County Government for public benefit," EACC said.

In the suit filed, EACC informed the Court that the property, having been alienated for public use, was not available for allocation to the Councilor or any other person.

The commission said the allocation of the land to a private person by the Mayor and Town Clerk was, therefore, illegal, fraudulent, null and void.
