Trial of Bomas CEO Koria in Sh8.6m graft case to start in July

Koria has denied charges of procurement irregularity amounting to Sh8.6 million.

The trial of the Sh8.6 million graft case against Bomas of Kenya CEO Peter Gitaa Koria will commence in July after the prosecution supplied him with documentary evidence Monday. 

The pretrial directions were before Magistrate Celesa Okore.

The prosecution told the court that it had served the accused person and his advocate in person witness statements they intend to rely on in the case.

DPP also said it intends to call 33 witnesses to testify against Koria.

"We have marked a total of 114 documents and served the accused personally. We have also cautioned him that should he wish to serve the lawyer, he should make copies for him to avoid any issue in the event we have a problem with his advocate," the prosecution said.

The court was also informed by the prosecution that there is only one witness whose statement is yet to be provided to the defence. 

The prosecution requested three weeks for it to be supplied to the defence. 

The court also heard that the defence had raised issues with some documents issued saying they were not clear. 

The DPP pledged to serve clear ones.

However, the defence lawyer questioned the legibility of some documents.

"We need a mention after three weeks to confirm the compliance of documents to be supplied to us," Koria said through his lawyer. 

The magistrate set June 18 for a mention to confirm compliance with the statements from the prosecution. 

The hearing of the case was also set to start on July 29.

Koria has denied charges of procurement irregularity amounting to Sh8.6 million.

The fraud, according to the prosecution, was committed between December 29 and 30 June 2021.

It is alleged that Koria being the CEO and Accounting officer of Bomas of Kenya, willfully failed to comply with the law relating to procurement.

He was accused of engaging in a procurement process without an approved budget for various tenders during the financial 2020/2021.

The charges indicate that Koria engaged in procurement irregularities in the award of the following public tenders: Quotation No.15/Kitchen Items; Quotation No.16/Utensils; Quotation No.17/Kitchen Items; Quotation No.18/Plates & Cups and Quotation No.19/Cutlery and Other Items which were not factored in the Bomas of Kenya's Budget and Procurement Plan FY 2020/2021.

He is out on a cash bail of Sh1 million.
