MPs vow to revive CDF once they take office

A section of the Members of Parliament has vowed to push for the revival of the Constituencies Development Fund (CDF) once they resume office.

They defended CDF saying it helped in initiating development projects in the constituencies.

Westlands MP Tim Wanyonyi said the parliamentary committee will review the CDF which had been banned by the Supreme Court.

"CDF that the Supreme Court said is unconstitutional is the initial one. This one of the national government which was aligned with national function is still in existence. I know it also has a case in court, that is something the committee will have to look at when the house convenes," Wanyonyi said.

The Supreme Court banned the release of CDF terming it illegal.

The court ruled that allowing MPs to manage the funds is against the Division of Revenue and Public Finance law.

“A declaration is hereby made that the Constituency Development Fund Act, 2013 is unconstitutional,” the verdict given by the five-judge bench read in part.

"We agree with the reasoning adopted by the High Court to the effect that the CDF Act 2013 violates the principle of separation of powers and that the CDF Act 2013 is unconstitutional."

Kwanza MP-elect Ferdinand Wanyonyi while speaking on Thursday at the 13th parliament orientation, reiterated the importance of CDF.

He said they will be forced to go to court to bring the CDF back.

"We will even go to court to bring CDF back because people do not understand the importance of development,  from the time CDF was started in this country,  so much has been done," Wanyonyi said.

"CDF should not be interfered with because it has no problem, it has not committed any crime, it is there to help Kenyans," Tongaren MP-elect said.
