Court allows State to take 410 acres of KU land

The petition was seeking to stop State from taking over and investing in 490 acres of land

The court has dismissed a petition by reinstated Kenyatta University Vice Chancellor Paul Wainaina and former council chair Migot Adhola.

The petition was seeking to stop the government from taking over and investing in 410 acres of land belonging to the institution.

"On it's part, the 1st,2nd,3rd,5th and 6th respondents have taken the position that the suit property is public land which was allocated to the university by the government of Kenya," the court ruled.

The mentioned respondents are Head of Public service Joseph Kinyua, KU council, Attorney general, ministry of land PS and CS.

According to Judge Oscar Angote, by surrendering the title deeds, the council understood that the initiated projects on the aforementioned land were out of goodwill.

"In view of the public purposes that the said land will be used for, it is my finding that the petitioner has not established a -prima facie- case with chances of success," Angote said.

Angote, therefore, dismissed the petition by the Law Society of Kenya versus six other respondents and two interested parties.
