Chebukati: DPP to handle Kuria, Sabina Chege rigging case

Chebukati said he will forward their files to DPP Noordin Haji for action.

The Independent Electoral and Boundaries Commission has said it will refer the case on election rigging claims against MPs Moses Kuria and Sabina Chege to the office of the public prosecutions.   

The chairman of electoral agency Wafula Chebukati said on Friday he will forward the files of the Gatundu South legislator and the Murang'a Woman representative to the to the Director of Public prosecution Noordin Haji for action.

He said that this is after the High court declared the commission's role over the cases illegal.

Chebukati said the commission had prepared to robustly enforce the electoral code of conduct in the run up to the August 9 polls.

But with the court annulling it's role, he said, his commission will just do exhaustive investigation of the cases and then collaborate with Haji's office to have the accused persons prosecuted in court.

The commission has accused Kuria and Chege of breaching the code of conduct by making claims over election rigging.

Kuria made the remarks on March 15 at Kasarani stadium while Chege made her claims during a campaign rally in Vihiga County on February 10.

Kuria recently defended himself on TV saying his remarks about aiding the in allegedly rigging president Uhuru Kenyatta into office were taken out of contest.

He was asked, “Mliimba ama mliiba?” - Did you sing or did you steal?

“You know we have all these linguistic challenges, but we didn't choose where to come from. So all our ethnic influence, accent and all that can sometimes get lost in the translation,” Kuria said.

“But it’s on record...tuliimba ndani, ndani ndani to the state house.
