Businessman suspected of funding Dusit attack to face trial

A businessman charged over DusitD2 Hotel attack that left 21 people dead in 2019 has been put on his defence.

The court found that Hassan Abdi Nur has a case to answer.

Nur, who operated several M-Pesa outlets in Eastleigh, was put on his defence in relation to the charge with making false documents. 

He is also charged with obtaining registration by falsely pretending to be a Kenyan citizen and uttering a false document. 

Milimani senior principal magistrate Kennedy Cheruiyot, in his ruling, said the prosecution had proved beyond reasonable doubt that Nur committed the offences against him.

Nur was however acquitted of other charges of  financial promotion of an offence contrary to Section 7 as read with Section 16(1) of proceeds of Crime and Anti-Money Laundering Act.

The magistrate also acquitted his two co-accused persons namely lawyer Abdinoor Maalim and businessman Hassan Abdi Mumin for lack of evidence.

All of them had denied charges of financially supporting the terror suspects who allegedly hit the hotel by transmitting money to them through M-Pesa.

They were suspected to have  supported terrorism activities by receiving and transmitting Sh34,736,550 to the attackers through the Diamond Trust Bank, Eastleigh branch, Nairobi county.

Nur alone was charged with irregularly acquiring a National Identity Card, a birth certificate and a death certificate in Marsabit, which he allegedly used to register the enterprises.

Nur, who was being charged alongside Abdinoor Maalim Osmail and Abdiwahab Abdullahi Muhumed Hassan, operated several M-Pesa outlets, among them Aslands Agencies Limited.

Meanwhile Hassan, who is charged alongside Nur, has denied providing services to slain terrorist Ali Salim Gichunge alias Farouk Daud by transporting his parcel, which contained highly explosive materials.

The other co-accused, Osmail, denied financing the terrorism by transmitting to Sh19,748,724 to an unidentified person with an intention to commit a terrorist act.

He operates an M-Pesa outlet trading under the name Seatech Limited.

Cheruiyot is yet to fix a defence hearing for the case against Nur.
