Court summons ex-detective in Thuo murder case

A Nairobi court has summoned a former Investigating officer Frank Onuda to testify in the trial of six people are charged with the murder of former Juja MP George Thuo.

High Court judge Roselyne Korir issued the summons on Thursday after it emerged that some bottles and glasses which he forwarded to the Government chemist for analysis were recovered in  Thuo's car.

Earlier indication by the prosecution suggested that nothing was recovered in the vehicle which was parked within Porkies bar in Thika town in 2013. 

The  accused in the case are, club owner Paul Boiyo alias Sheki,  Thuo’s aide Christopher Andika alias Lumba, DJs Andrew Wainaina and Samuel Ngugi alias Visi, waiter Esther Mulinge and patron Ruth Irungu alias Atlanta.

Following the new twist that there existed an exhibit memo and inventory showing that there were other items recovered from the motor vehicle belonging to the late MP, the prosecution sought for summons against Onuda.

He was among the investigating officers in the matter and appended his signature on the same memo and the inventory.

Justice Korir was forced to temporarily adjourn the case to enable prosecution, sort out some issues on exhibits in the matter and have Onuda testify in the case.

The new details  emerged during the cross-examination of investigating officer chief inspector Maxwell Otieno by a team of defence lawyers.

They wondered why other exhibits memo were only indicating that some alcoholic bottles and glasses were recovered at the bar.

The defence questioned the inconsistency  in the number of bottles that were recovered at the scene of crime.

Some of the state  witnesses have indicated that Thuo took only three beers while some claim he took 25 bottles.

At the same time Justice Korir ordered the prosecution to avail a pathologist's report of samples that were sent to a South Africa laboratory relating to the matter without further delay.

While issuing the directive Korir said the report has never been availed in court for over 3 years since it was brought to the court's attention.

The order comes after Otieno informed the court that he was unable to obtain the report from the South Africa lab where he traveled following the earlier court order. 

" Your honour, i was unable to get the report from the laboratory since they were demanding Sh 1.2 million in order to release the said sample results,"Otieno said.

 The report is crucial in the matter as it is expected to reveal what really caused the death of MP Thuo.

The court was informed  some samples from his body were extracted and sent to South Africa for final analysis on the cause of his death.

The defence lawyers supported the decision to have the report from South Africa tabled in court as evidence in the case.

On Wednesday, during his testimony Otieno told the court that Thuo was poisoned through drinks at the bar.

He told Justice Korir that they took bottles of Tusker beer and the clothes which the deceased was wearing to the Government chemist where the result revealed that Thuo was poisoned.

He said that a doctor who conducted a postmortem on the former MP, informed him that the deceased was poisoned and that he died due to excessive bleeding.

The officer told the court he interviewed all the accused persons in the case and found that from their own statements, there was a possibility that they took part in the alleged poisoning.
