Matiang'i threatens to sue Itumbi over defamatory tweets

Itumbi expected to issue an unconditional apology to Matiang'i and immediately expunge the defamatory statements from his account.

Interior CS Fred Matiang'i has threatened to sue self-proclaimed 'Hustler spokesman' Dennis Itumbi over tweets he says are defamatory.

In his tweets, Itumbi is accused of calling Matiang'i “the Ruaraka land thief” and “the Ruaraka thief”.

Through his lawyers, Matiang'i demanded that Itumbi retract all tweets referring to him as a thief.

He is also expected to issue an unconditional apology to Matiang'i and immediately expunge the defamatory statements from his account.

"Our client further demands an unconditional apology for the defamatory statements published via your verified Twitter account in a manner to be approved by our client," Nyamodi and advocates said on Wednesday.

"We are further instructed to demand as we hereby do your immediate admission of liability whereupon our client shall engage you on the quantum of damages and any other retribution for your defamatory publications."

If Itumbi does not comply by Friday, legal proceedings will be pursued against him.

In the letter, Matiang'i said on diverse dates between  July 9, 2021 and August 9, 2021, Itumbi published a series of highly defamatory and malicious allegations.

“This defamatory statement has resulted in 103 retweets, 5 quote tweets and 732 likes as at 11th August, 2021,” the lawyers said.

Matiang'i said the series of defamatory captions, taken in their ordinary meaning by right thinking members of the society, are falsely understood to mean that the CS has been found guilty of corruption.

The lawyers said the use of the words are a deliberate misrepresentation of facts published with the sole intention of injuring the CS's reputation.

"The series of defamatory tweets were published in full awareness and cognizance of the facts pertaining to the subject matter of your defamatory statement," they said.

The tweets, they say, have resulted in Matiang'i being unjustly scandalised and exposed to hatred, ridicule and contempt as a government official and a leader in his social circle.
