Sarah Wairimu Cohen, the widow to slain businessman Tob Cohen has accused her sister-in-law of filing in court a fake will.
Through her lawyer Phillip Murgor, Wairimu claims they hired an expert document examiner who confirmed that the will was forged.
"Through an expert document examiner in a forensic report has confirmed that the said will is a blatant forgery and obtained through fraud," her petition read.
In the application filed in court, Wairimu further seeks to cross-examine her sister-in-law Gabriele Van Straten regarding material aspects surrounding the alleged forgery of the will.
She also wants the court to disqualify Lawyer Danstan Omari and his law firm from representing the Cohen family arguing that they are conflicted as Omari is a witness in the murder case against her.
Meanwhile, DPP Nordin Haji and DCI George Kinoti have asked the court to remove them from the succession case filed by Wairimu.
State Counsel Catherine Mwaniki told Justice Lydia Achode that the DPP and DCI have no interest in the late Cohen estate and they should be removed.
Mwaniki added that the allegations of forged will by Wairimu will be investigated by the state and they can only do so from outside the case as neutral arbitrators
Murgor told the court that they don't believe the DPP will be fair in their investigations as they believe he has been biased in the matter.
Mwaniki, however, objected to Murgor claims that the state had colluded with the family.
