A secondary school teacher in Kirinyaga was on Thursday arraigned at a Baricho law court over alleged sodomy.
The court had directed that the investigating officer physically presents the suspect before it.
William Kinyua Mutuanjau is accused of contempt of court for not attending a mention of the case on Monday last week.
In his defence, Kinyua told Baricho senior resident magistrate, David Ireri, that he failed to show up in court because he was sick.
On Monday, the suspect was represented by a man who said he was his cousin.
He, however, failed to produce his documents to support his relationship with the accused person claiming he did not have any identification documents.
The suspect has been out on a Sh100,000 bond with a surety of a similar amount after he pleaded not guilty for two counts of sexually assaulting a 23-year-old man.
According to the charge sheet, the suspect is accused that on March 28 within Sagana township in Kirinyaga County, he intentionally and unlawfully caused his penis to penetrate the private part of his victim by use of force.
On the second count, the suspect is accused charged with committing an indecent act with an adult.
Information availed to the press by area OCPD Moses Kosgei, the suspect is alleged to have lured the 23-year-old man with a bottle of beer which he spiked with a drug prior to committing the heinous act.
"The victim is a car washer in Baricho town. On the said day, Kinyua allegedly went to pick it from the victim who was by then attending to it. It is at that point that he offered to buy him a drink at Sagana town. The victim entered his car and they both left to make merry make in the local town."
The victim is then said to have slipped into drowsiness after some few gulps of the beer and the suspect took him to his vehicle and sexually abused him.
After the incident, the suspect is said to have dumped the unconscious car-washer into the Sagana river.
"He thought he was dead after sexually abusing him and so he decided to dump him into the river. Fortunately, he regained consciousness on Wednesday and was found by a group of women who were drawing water from the river while stark naked," Kosgei said.
The case was adjourned and hearing set for July 24, 2023.
