DJ Joe Mfalme released after 14 days of detainment

Joseph Mwenda popularly known as DJ Joe Mfalme has been released from detainment.

The DJ had been in custody for 14 days alongside six others.

They had been held on request of the Directorate of Criminal Investigations and the state, so investigations into the murder of Kabete detective Felix Kelian could be concluded.

When they appeared in court today for directions, Kibera Magistrate Margaret Murage was told that the DPP had resulted to utilise the DJ and some six respondents as state witnesses.

The DJ's hypeman Allan Ochieng' was referred for plea-taking for murder at Kiambu High Court.

Speaking after the release, Advocate Ng'ang'a Mbugua raised an issue with the incarceration saying it was unjust to hold the six without probable cause.

The DJ had been held alongside Eric Kariuki Gathua, Simon Wambugu Wanjiru, Khadija Abdi Wako, Sammy Cheruiyot Rotich and Agnes Kerubo Mogoire.

Addressing the media, the lawyer made known of the intention to seek legal redress.

"The DJ and the team have a constitutional remedy. They could file a constitutional petition for damages from the officers who detained them and we shall be advising them on the same," Mbugua said.

He faulted the DCI for holding suspects before investigations saying probes should precede arrests and detainment.

He clarified that he was not against the Directorate carrying out investigations only against the pretrial detention of innocent persons.

"This is a worrying trend. This is something that should worry every believer in constitutionalism and fundamental rights," he added.

On March 25, when the DJ was first arraigned, the court heard that there was preliminary evidence against him and his co-respondents.

Today, however, it was told that there was no evidence against the aforementioned six.
