DJ Joe Mfalme to be state witness in cop's murder case

The DPP in a letter dated April 5 advised that the second to the seven respondents be witnesses in the case.

DJ Joe Mfalme will now be a state witness in the murder case of Kabete Police Detective Felix Kelian.

This is after the Director of Public Prosecutions in a letter dated April 5, 2024, advised that the second to the seven respondents be witnesses in the case.

In the same letter, the DPP charged the first respondent Allan Ochieng' with the murder.

He is expected to be charged before Kiambu High Court on Monday, April 8.

Kibera court Magistrate Margaret Murage closed the miscellaneous file, which will facilitate the release of DJ Joe and the five others.

The others include Eric Kariuki Gathua, Simon Wambugu Wanjiru, Khadija Abdi Wako, Sammy Cheruiyot Rotich and Agnes Kerubo Mogoire.

The orders were issued after the Investigative Officer in the case requested the same.

"I did the investigations and forwarded the file to the homicide unit who forwarded it to ODPP. I wish to close the application," Officer Fredrick Kosen told the court.

The six including the hypeman Ochieng', had been detained for 14 days as the Directorate of Criminal Investigations (DCI) carried out a probe into Kelian's murder.

The investigating officer had then said preliminary investigations revealed that Officer Kelian was involved in a slight accident while driving his Subaru, near Kikuyu Police Station on March 16.

The vehicle hit another vehicle which had five occupants.

He stated that Wako, a traffic police officer visited the scene and found the late detective being beaten.

He was taken to Kikuyu Police Station, as he complained of abdominal pain and was passing blood while urinating.

At the station, two other officers Cheruiyot and Kerubo were on duty.

The investigating officer stated that Kelian was released but on his way home, his situation worsened and he was rushed to Nairobi West Hospital where he was admitted with lower abdominal pain.

He died on March 21.

When the case came up for mention today, the court was told that there was no evidence to facilitate the prosecution of the six including DJ Joe.
