The hearing of the appeal filed by pastor Ezekiel Odero seeking to reopen his TV station failed to start this afternoon due lack of quorum in the tribunal.

Tribunal chair Rosemary Kuria informed parties in the matter that the communication and multimedia appeals tribunal was not properly constituted.

She said as of now they are only four but they need one more member before they hear the matter.

She further said the fifth member who was supposed to be sitting with them has been unavailable for a while and the Ministry of ICT has not provided other members.

Lawyer Danstan Omari asked if the tribunal could communicate to them officially on the issue of a quorum so that they can seek alternative legal redress elsewhere.

In her directions to court, the chair said the case could not proceed for lack of quorum in the tribunal even though the applicant was ready to proceed.

Parties were told that they will be contacted once there is a quorum in the tribunal.
