Two witnesses to testify in Waititu graft case before closure

The prosecution is remaining with two more witnesses before it closes the Sh588 million graft case facing former Kiambu governor Ferdinand Waititu and others.

The two are a document examiner and an investigating officer.

The examiner was to appear in court on Wednesday but the prosecution on Tuesday asked the court to allow their application for adjournment as the witness would not be available.

The court heard that the witness will be attending to a separate matter in Homa Bay. So far, 27 witnesses have testified in the case. 

Trial Magistrate Thomas Nzyuki allowed their application saying the prosecution should ensure the witness will be in court on June 5, when the case will resume.

The Magistrate said even if he will not be available, then the prosecution should be able to avail the investigating officer to give his evidence in the case.

Waititu, his wife Susan Wangari and 11 others are facing trial over the irregular award of Sh588 million roads tender in Kiambu county.

The tender in question was issued on February 12, 2018, and awarded to Testimony Enterprise owned by its directors— Charles Chege and Beth Wangeci-after quoting Sh588 million.

It was for upgrading of various gravel roads in Thika, Limuru, Gatundu North, Juja, and Ruiru subcounties during the financial year 2017-2018.

Investigating agencies say the tender was irregularly awarded and that's how the matter landed in court.
