The Sh588 million graft case facing former Kiambu governor Ferdinand Waititu and others will proceed for a hearing today.

On Monday, Charles Mwaniki the Director of Charwims Limited told an anti-corruption court that he was never notified whether he had lost or won the Sh588 million roads tender by the Kiambu county government.

He was one of the bidders that participated in the Sh588 million Kiambu roads tender.

He was testifying against Waititu, his wife Susan Wangari, Testimony Enterprises, its directors and others.

They are facing trial over the irregular award of Sh588 million roads tender in Kiambu.

The tender in question was issued on February 12 2018 and awarded to Testimony Enterprise owned by Charles Chege and Beth Wangeci-after quoting Sh588 million.

The tender was for upgrading of various gravel roads in Thika, Limuru, Gatundu North, Juja and Ruiru subcounties during the financial year 2017-2018.

Mwaniki told trial magistrate Thomas Nzyuki he got to know the tender was awarded to another company when the anti-graft was investigating the matter.

He cited a letter from the county government of Kiambu dated March 8 2018. It was addressed to them.

"We were expecting to be notified by the institution of Kiambu on whether we had won the tender or not," he said.

"Normally, they write a letter to participating contractors. But by the time I was called at EACC, I had not received the letter. I saw it for the first time at their offices." 

The March 2018 letter was informing him that he did not qualify for the tender. But he only became aware of it when the case was being probed.

He said five bidders participated in the tender.

The tender was subsequently awarded to Testimony which investigating agencies have said was done so irregularly.

Separately, a court in Kibera will be sentencing a driver accused of defiling two minors in 2020.

Also, a man who threatened to kill his father over an inheritance dispute in Kawangware will be charged today.

The Kibera court is also expected to proceed with the hearing of a poaching case where two suspects are charged with possession of ivory worth Sh20 million.

Their whereabouts remain unknown but a warrant of arrest had been issued against them.
