Rule of law will be applied in Matiang'i case - Haji

Matiang'i is accused of spreading false information about an alleged police raid.

Director of Public Prosecutions Noordin Haji has said the rule of law will be applied as they handle the case of former Interior Cabinet Secretary Fred Matiang'i. 

Haji said on Wednesday, he received the duplicate file relating to the allegation that police officers visited and prevented access to Matiang'i's home. 

Additionally, it was claimed that the police had the intention of arresting  Matiang'i on the night of February 8, 2023, for undisclosed offences.

"The duplicate file herein will be reviewed, and a decision thereto, shall be made in due course, based on the evidence, facts, the law, and the Decision to Charge Guidelines, 2019," he said. 

Haji reiterated that his office is committed to upholding the rule of law and that all persons will get a fair trial. 

On Tuesday, Matiang'i in the company of his lawyers appeared before DCI offices for grilling over claims of publication of false information.

The lawyers present were Danstan Omari, Otiende Amollo and Okongo Omogeni among others. 

The former CS is being accused of spreading false information about an alleged raid at his Karen residence by a group of police officers.

The DCI said the offence is contrary to Section 23 of the Computer Misuse and Cyber Crimes Act of 2018.
