Eugene to state: Use right channels to air grievances about Judiciary

DAP-K party leader Eugene Wamalwa has criticised efforts by the executive to undermine the judiciary.

Speaking during an interview on Monday, Eugene urged the Kenya Kwanza government to use the right channels to air their grievances about the judiciary.

He urged them to follow in the footsteps of Azimio in criticizing the judiciary, citing their response to the election ruling.

“Our courts are not infallible. We in Azimio have criticized them before, remember the hot air judgment. We were very unhappy with it, but eventually we accepted it as people who respect the rule of law,” Wamalwa said at Spice FM.

He also condemned the attacks directed at the judiciary saying they might undermine the country’s democracy.

“There is nothing wrong with positive criticism over any institution, but when there is open aggression aimed at intimidating an institution, then our democracy is challenged,” he added.

Recently, there has been a dispute between the government and the judiciary.

President Willian Ruto has accused the judiciary of being corrupt and accused some judges of working with cartels to obstruct his legacy projects.

Lawyers, led by LSK President Eric Theuri held peaceful demonstrations last Friday to address the constant attacks from the executive.

Going further, Eugene also cited the historic Supreme Court ruling on LGBTQ saying that even though a lot of Christians and Muslims disagreed with the ruling, they had to follow the right channels in addressing their concerns.

In relation to that, Eugene asked the country’s executive arm to follow suit and use the right channels to address their concerns.

“Recently, there was also another ruling by the Supreme Court on the issue of homosexuality, most of us as Christians and Muslims disagreed with that ruling… If you have any issue with an institution, please follow the laid down procedures,” he said.

On Sunday, Deputy President Rigathi Gachagua announced his plan to petition the Judicial Service Commission to have a High Court Judge removed from office.

In response, LSK President Theuri challenged the DP  to substantiate any accusations connecting judicial officers to corruption.

He urged the Deputy President to present any allegations of corruption to the Judicial Service Commission rather than expressing grievances in the public domain.

"If you possess evidence of corruption against a specific judge, the appropriate channel is to present it to the Judicial Service Commission. Making public pronouncements is unnecessary; let us wait and see what unfolds," Theuri said.
