Jumwa seeks to be enjoined in case challenging Haji’s spymaster job

Public Service CS Aisha Jumwa now wants to be enjoined in the case where an activist has challenged the nomination of DPP Noordin Haji as the next NIS director.

Jumwa through lawyer Danstan Omari has defended Haji’s decision to withdraw charges against her which is one of the reasons the petition was filed in court.

She says her name has been adversely mentioned in the said petition as one of the people that Haji dropped their cases in court.

The CS says that in her case, she is the one who wrote to the DPP through her lawyers asking the DPP to review the evidence against her.

“It is the applicant herein who wrote to the office of the Director of the Public Prosecution beseeching that it exercises its power and drop charges against her in Mombasa High Court Criminal Case No.E11of 2020 and Anticorruption case no.6 of 2020 which were from the onset politically motivated,” the application reads

She argues that the petitioner is misconceived by alleging that cases instituted by the DPP against her were irregularly withdrawn.

Jumwa claims that the petitioner is making adverse assertions in a deliberate tactic to impede Haji’s smooth assumption of the office of the director of the National Intelligence Service (NIS).

She has further argued that the said petitioner neither informed, consulted nor sought her permission before instituting these proceedings.

“It is crucial to emphasize that any allegations against Haji’s actions as the Director of Public Prosecution should have been legally challenged or raised at the appropriate juncture. The current endeavour to raise such issues appears to be a calculated and malicious act,” reads court papers.

She has urged that court to enjoin her as an interested party, saying she has an identifiable stake in the proceedings hence enabling her to argue her case and advance her unique interests which cannot be advanced by any of the other parties.
