Liquor tycoon Mohan Galot and seven others have lost a bid to stop their continued prosecution in a series of forgery cases.

High court Judge Freda Mugambi dismissed the case filed by the eight on grounds that the matter has already been litigated by other courts.

The other seven are Rajeev Modi, Pushpinder Singh Mann, Jophece yogo who are bosses of Galot industries, Manchester Outfitters Limited, Kings Woolen Mills Limited and London Distillers Kenya.

Mohan was charged at the Milimani Courts with making a false notification of change of directors of King Woollen Mills Limited, purporting it to be a genuine document.

Rajeev, Pushpinder and Jophece on the other hand were charged with perjury and making a document without authority.

They subsequently moved to the High Court to challenge the criminal cases.

The criminal cases relate to forgery, giving false information and fraudulent transfer of assets by Mohan.

They wanted the cases stopped and for the court to compel the Director of Public Prosecution to arrest and charge their rivals, Pravin Galot, Narendra Galot and Rajesh Galot.

They have been fighting over the ownership and control of the family’s multi-billion estate.

Mohan claimed there was collusion between officers of the Inspector General of police, the DPP and Pravin in a bid to harass and defraud him.

But Justice Mugambi said the issues the eight were contesting have since been settled by different divisions of the High Court.

"I reiterate my finding that the issues raised in this petition have been previously canvassed in other forums which the respondents expended time and costs to defend," she said.
