Former Treasury CS Henry Rotich will be back in court on Monday as the Sh63 billion Arror and Kimwarer dams scandal case is mentioned.

The mention follows the elevation of former trial magistrate Lawrence Mugambi to a High Court judge.

As such, Mugambi last month directed that the matter be allocated to another magistrate.

Rotich had been charged alongside former Treasury Principal Secretaries Kamau Thugge and Susan Koech and some 20 Italians but the DPP amended the charge sheet and excluded the ex-PSs and made them state witnesses.

Rotich was thus charged afresh even though the DPP said no new evidence would be brought against the former minister.

"Considering it’s a fairly new hearing I think it will be prudent to take it to another magistrate,” Mugambi said last month as he sent the file back to the Chief Magistrate for reallocation.

He said if it was the last witness, he could have proceeded to conclude the matter and written a judgement.

"The trial court has been elevated considering two witnesses have testified it’s not convenient for the court to hear the case as there are many other witnesses who are yet to testify,” Mugambi said

The case will be mentioned before senior principal magistrate Eunice Kagure Nyutu for fixing of new hearing dates.

Only two witnesses had so far testified in the matter with the second witness yet to be cross-examined.
