I beat Metito fairly in polls, Lenku tells election court

Says he had a functional tallying centre, whose results were streamed from the polling stations.

Governor Joseph Lenku on Tuesday told court in Kajiado he beat Katoo Metito fair and square in the August 9 gubernatorial race.

Lenku said his win was "incontestable" as the electoral process managed by the Independent Electoral and Boundaries Commission was "transparent, free, fair and verifiable".

The governor told Justice Janet Mulwa at the High Court in Kajiado that he had a functional tallying centre, whose results were streamed in real-time from the polling stations by his agents and that there were no anomalies.

“I polled 117,600 votes against Mr Metito 111,725 to emerge victorious,” Lenku said. 

The county chief said a sample of polling stations produced in court from all the constituencies showed that party agents had signed all the results announced by the electoral agency.

In cross-examination by IEBC lawyer Peter Wanyama, Lenku said his tallying centre did not receive any case of voter bribery or harassment of agents by anybody. 

The governor also said he went to the tallying centre in Kajiado immediately after casting his vote. 

"I did not visit any polling station to monitor how the voting was going on. I had a team that was monitoring the process at every polling station," he said. 

Lenku appeared in person at the election petition court to face the lawyers for the IEBC and the petitioners in cross-examination.

The governor, however, admitted that Metito defeated him in Kajiado North and Kajiado South but that his competitor recovered the loss with a big margin in Kajiado Central, Kajiado East and Kajiado West constituencies.

Lenku also said his presidential candidate in the Azimio La Umoja coalition Raila Odinga won the presidential vote in the county, even as UDA bagged the senatorial and woman representative seats.

The governor was responding to questions by lawyers representing the electoral and commission and the petitioner, Paul Kerempu.

Kerempu replaced Metito as the petitioner after the latter was appointed State House comptroller by President William Ruto.

Justice Mulwa said she was ready to conclude with the petition by December 27 but the lawyers agreed to push the judgement to January.
