The vetting of Principle secretaries nominated by President William Ruto is set to commence immediately, Speaker of the National Assembly Moses Wetangula has said.

The vetting exercise had stopped after the court issued a gag order over a case that was pending before it.

But on Tuesday, Justice Mathews Nderi threw away three petitions seeking to quash the nominations made by Ruto.

The dismissal of the petitions now paves the way for the vetting exercise.

Wetangula has now directed the vetting exercise to continue with immediate effect.

MPs will now race against time to conclude the vetting of PSs as soon as possible.

The PSs are likely to be sworn into office on December 2.

Justice Nderi in his ruling said the court can only be approached once the National assembly has concluded the vetting process and written its report.

“This court will only be called upon the conclusion of the vetting process by the National Assembly this is a sacred mandate given to the House by the people of Kenya and the court must pay the difference of the House in that respect accordingly the consolidated cases have been filed prematurely,” Nderi said.

Two weeks ago, Justice Nzioki Wa Makau issued a conservatory order stopping the vetting that was already underway in Parliament.

The National Assembly had argued that, according to the law, if the 51 nominees are not vetted within 28 days then they will automatically be sworn into office.

The LSK, however, objected saying that cannot happen since it is the court that stopped the exercise.
