Court bars opening of Kombani market in Kwale county

The contractor is seeking Sh44 million in arrears for the construction of the Sh106 million market.

A court has barred the Kwale county government from conducting any activity at the Kombani market until a case filed by End to End company is heard and determined.

The firm is seeking Sh44 million as arrears from a total of Sh106 million for constructing the market. 

In her ruling on Thursday, Justice Njoki Mwangi said the county government should not conduct any operations in the market.

"Upon reading the notice of motion application dated October 13, 2022 it is hereby ordered that pending the hearing and determination of the application dated, the status quo pertaining as of today shall be maintained," the judge said.

"For the avoidance of doubt, there shall be no opening, no launching, no entry into premises of the market in issue by the respondents or anyone acting on their instructions,” she directed.

The court directed the police to ensure the orders are enforced and no one should access the market.

"The Regional police commander and the regional police commissioner are directed to ensure that the above orders are enforced and that peace is restored in the Market," Justice Mwangi said.
