19 to testify against cop for murder of boy during Covid curfew

The state will be calling 19 witnesses to testify against a police officer charged with the murder of 13-year-old Yassin Moyo.

The postmortem report, which was admitted in court, revealed that the deceased died of excessive bleeding due to a single gunshot wound in the abdomen.

A mandatory pre-trial mental assessment conducted on the accused also revealed he is fit to stand trial.

The prosecution told justice Justus Bwonwong'a that of the 19 witnesses, 14 are eye witnesses while the others are circumstantial.

Each witness, the prosecution told court, will testify for 30 minutes.

Lawyer Danstan Omari, representing Duncan Ndiema, said the defence team will challenge the ballistics report.

Hearing will commence on January 23 to March next year with specific dates set aside for the matter to be heard expeditiously.

Ndiema was charged before justice Luka Kimaru on June 23, 2020 with the murder of Moyo. He denied the charges. 

He was released on a Sh1 million cash bail on condition he does not interfere with the witnesses lined up to testify against him. 

Ndiema was in uniform when he allegedly committed the crime. He also had an Israeli-made pistol serial number 44338354 loaded with 10 bullets.

He was shot and killed on March 30, 2020, while standing at the balcony of his parents flat in Mathare.

The deceased was laid to rest at the Kariokor Muslim Cemetery in Nairobi.

Two months later, the Director of Public Prosecutions Noordin Haji approved the arrest and prosecution of Ndiema.
