Light moment in court as Smokin reacts to Solomonic wisdom plea

The Supreme Court on Thursday yet again shared a light moment after Justice Smokin Wanjala weighed in on Senior counsel Kioko Kilukumi's submission.

Kilukumi had equated the petition before it to the biblical case of two women who were fighting for the ownership of a child.

He said the arguments presented by ODM leader Raila Odinga are similar to one presented by the biblical woman who was falsely claiming the child was hers while casing with King Solomon.

"I wish to ask the court humbly, to reflect on the ruling of King Solomon; just like him before you, you have two gentlemen here, each one claiming the baby, which is the outcome of the 2022 elections," he said.

While commenting on the argument presented by Kilukumi, Justice Wanjala ostensibly asked Kilukumi if he was willing to have the "baby", that is President-Elect William Ruto's victory, to be handed to the petitioner.

"Mr Kilukumi you know you cited King Solomon and this court treats Holy scriptures very seriously.....But I also remember the mother claimant, who according to King Solomon could not have been the mother is the one who was saying cut the baby, but the other one, I remember said, no let her take the baby, because she was interested to preserve the baby," he said.

"Would you be willing to advise.....?" Justice Wanjala posed as he left for the lawyer to conclude for himself.

This prompted laughter from the court attendees as Kilukumi appeared to disagree with him on that.

Kilukumi said Raila Odinga, just like the claimant's mother, is telling the apex court to give him the victory or split it.

He added that Raila's prayers are a clear indication that he is not the election winner.

"That 'baby' belongs to Honorable William Samoei Ruto, give him his 'baby'. The petitioner is telling you either give him victory or nullify the elections, King Solomon used that to know the true mother," he said.

Kilukumi added, "I urge the court to give the 'baby' to the legitimate and lawful father who is William Ruto."
