The East Africa Court of Justice has directed Attorney General Kihara Kariuki to file a response within 45 days to the appeal lodged at the court by former Nairobi governor Mike Sonko.
Sonko moved to the court on Monday seeking a review and setting aside of the Supreme Court judgment that upheld his 2020 impeachment.
"You are hereby notified that the above-named applicant has instituted a reference against your copy which is annexed hereto," the registrar of the court said.
"You are required to file a response to reference within 45 days from the day of service hereof. In default whereof, the reference will be heard and determined in your absence," he added.
Through Derrick Odhiambo Advocates, Sonko has also written to the IEBC terming the revocation of his clearance certificate null and void.
Sonko argues that until he exhausts all appeal mechanisms, he does not stand disqualified.
"We reiterate that unless the review at the Supreme Court of Kenya and further appeal at the East African Court of Justice is heard and determined, the contents of your letter and action is an annuity," the law firm said.
"We demand that you revoke unconditionally the contents of the said letter and gazette our client to vie."
The law firm said it will institute contempt charges if the revocation is not withdrawn.
