Jitters as Supreme Court set to rule on Sonko’s impeachment

If the supreme court upholds the decisions of the lower courts, Sonko will never contest for any political seat.

All eyes are set on the Supreme Court which is expected to deliver its judgment in an impeachment appeal case filed by former Nairobi Governor Mike Sonko.

Sonko had earlier filed the appeal at the apex court after both the Court of Appeal and the High Court upheld his removal from office by the Senate.

In a notice late Thursday, Supreme Court registrar Letizia Wachira noted that the judges will, on Friday, render their judgment at 4 pm by way of an email.

The Supreme Court heard the appeal where parties argued their cases with Sonko insisting his impeachment did not meet the threshold set under the Constitution.

The appeal was heard on the day Independent Electoral and Boundaries Commission (IEBC) cleared him to run for Mombasa Governor’s seat in the August polls.

It came after the decision by a three-judge bench to direct IEBC to clear him after overturning its earlier decision not allowing him to run.

If the Supreme Court upholds the decisions of the lower courts, Sonko will never contest for any political seat, as his previous impeachment renders him unfit to hold a position in public office.

His name was left out of the list of candidates eyeing the Mombasa gubernatorial seat that were gazetted by the IEBC last week.

On his impeachment, Sonko firmly believes he was illegally impeached and that he is sure both the County Assembly and Senate lacked a quorum during that time.

On December 3, 2020, he was impeached by 88 Nairobi MCAs of the County Assembly which later proceeded to the Senate on December 17, 2020, where they upheld the resolution to remove him from office.

Early this year, Sonko went to the Supreme Court to challenge his ouster. This was after the Court of Appeal upheld a decision by the High Court that he was legally impeached in 2020.

The court also found that the Senate gave Sonko an ear before concluding that he ought to leave the county's helm.

Not giving up, he moved to the Supreme Court where a ruling will be issued on Friday.
