Ex-NSSF boss Francis Moturi convicted of graft to be sentenced today

Former NSSF Investment manager Francis Moturi will this afternoon (2 pm) be sentenced over his involvement in a graft case that led to the loss of Sh1.2 billion at the fund.

Anti-corruption magistrate Lawrence Mugambi on Friday found Moturi guilty of knowingly misleading the fund into making payments totalling Sh1.2 billion through irregular trading in shares through Discount Securities Limited.

Moturi, David Ndirangu and officials of Discount Securities Ltd (DSL), including Wilfred Mungoro (Finance director) and Isaac Nyakundi, were also found guilty of conspiracy to steal from NSSF through the purchase of shares.  

Today Moturi, through Lawyer Assa Nyakundi and Adan Mohamed, asked the court to take into account that he suffers from hypertension, diabetes, asthma, prostate enlargement and a history of disc herniation.

They also argued that there was no iota of evidence presented before the court to show that Moturi benefited from the proceeds that were the subject of the proceedings in court.

They asked Migambi to treat him with utmost leniency when sentencing him.

As for David Githaiga, Wilfred Weru and Isaac Nyakundi, their advocate, one Wilson, asked the court to take note that they are first-time offenders and that there was no evidence adduced in court by the prosecution to show that they benefited from the lost funds.
