Cops conduct during 2013, 2017 polls return to haunt them

Ipoa recommends that four police officers be charged with murder and manslaughter

The Independent Policing Oversight Authority on Wednesday recommended that four police officers be charged with murder and manslaughter in relation to deaths that occurred during the 2013 and 2017 polls period.

Sergeant Charles Mwakio and Corporal Julia Kimbiyo will be charged with manslaughter in relation to the death of Leonard Mramba in Korogocho slums, Nairobi, on August 15, 2013.

Ipoa chairperson Anne Makori said in a statement that Mramba succumbed to his injuries, which he sustained when the two officers were arresting him. 

Mramba's death has been the subject of an inquest at the magistrate's court. A court ruling on Tuesday upheld the evidence adduced by Ipoa, putting the two officers to stand trial. 

The authority also recommended that police Constable Peter Kananu be subjected to disciplinary proceedings for what it calls negligence in the performance of duty in relation to the death. 

The authority further wants police Constable Lewis Nguyo Msuya to be charged with murder in relation to the shooting of Said Muktar Ibrahim in Kisauni, Mombasa. 

The shooting took place on November 12, 2017. 

Ipoa said the officer was arrested on October 22. He was arraigned on Monday and is being detained for 10 days to allow for a mental assessment to determine if he is fit to stand trial.

Ipoa has also announced that an Administration Police officer was charged on Tuesday for gang-defiling a minor.

Makori said sergeant Jacob Ojiambo was charged in Githunguri law courts. In the case, Ojiambo and his brother Dismas Mujibu are alleged to have defiled a minor. 

The court has issued a warrant of arrest for Mujibu. He is still at large. 

Ipoa said the minor was a Standard 8 pupil at the time of the incident on April 14, 2019.

"The minor was allegedly defiled at the officer’s house within Mitahato AP Camp where the officer lived with his brother, a mathematics tutor who was well known to the girl," Makori said.

She said the case was initially investigated by officers at Githunguri police station before Ipoa took over the matter and conducted an independent probe.

"The investigation indicted Sergeant Jacob Ojiambo and his brother, findings that the authority forwarded to the Office of the Director of Public Prosecutions," Makori added.

"After an independent review of the case file, the ODPP concurred with the recommendations of the authority."
