Erdemann properties seek lifting of ban on Athi River construction

Claim they are losing Sh10 million daily due to the halt of constructing the estate.

Real Estate Firm Erdemann Properties have claimed they are losing Sh10 million daily as a result of the Environmental Tribunal halting construction of Great Wall Estate Phase III in Athi River.

The National Environmental Tribunal (NET) stopped Edermann’s construction of the multi-billion Great Wall Garden Estate Phase III in Athi River over a dispute in pollution in their sewer lines.

In a petition filed at Milimani Law courts, the company wants the court to suspend the order dated September 6 issued by the tribunal against them that lead to halting of construction of their mega project.

On August 12 London Distillers Ltd filed an appeal at the National Environmental Tribunal and later got orders stopping any further construction and developments being undertaken by Edermann in the said project.

It is their argument that they are incurring losses averaging Sh10 million a day on account of the violations of their fundamental rights further claiming that in the two weeks before the mention of the case they will lose Sh140 million.

Erdemann Properties say over 2,000 of their employees are currently out of jobs on account of the constitutional violations against them.

According to the real estate firm, the actions of the tribunal have occasion grave prejudice to their company and amounts to a violation of their rights.
