High Court bars police from arresting Gladys Wanga

High Court Judge Chacha Mwita has temporarily stopped police from arresting Homa Bay woman representative Gladys Wanga.

The judge further directed on Thursday that the legislator serve the government with her suit papers.

The order arose from an application filed by Wanga through lawyer Nelson Havi.

She said in her application that police are subjecting her to unjustified harassment.

Wanga further said acting Interior CS Fred Matiang'i stepped outside his mandate in directing that she be summoned without giving details of the offence she may have committed.

The suit was filed by Wanga and four others against Matiangi, police boss Joseph Boinet and DPP Keriako Tobiko.

The case will be heard on November 7.

The Directorate of Criminal Investigations had summoned Wanga to appear before IO Setim Kandie on Thursday.

The detective said the legislator has key information of benefit to the investigation.

Kandie did not disclose the nature of information they are looking for.

In the summonses, the detectives say they are conducting a probe grounded on a violation of Section 94(1) of the Penal Code.

This states: "Any person who in a public place or at a public gathering uses threatening, abusive or insulting words or behaviour with intent to provoke a breach of the peace or whereby a breach of the peace is likely to be occasioned is guilty of an offence."
