Cord Leader Raila Odinga yesterday released a dossier on Devolution CS Anne Waiguru and said she was spared from the list of shame by President Uhuru Kenyatta.
Addressing a press conference at his private Upper Hill office, the former Prime Minister said the government's IFMIS payments system that was headed by Waiguru is being actively probed by the Ethics and Anti-Corruption Commission over Sh1 billion.
The e-procurement system is intended to increase transparency and accountability.
It was the latest in a series of problems for Waiguru and the National Youth Service, where there was an attempt to steal Sh828 million. It also bought vast stores of foodstuffs at inflated prices, but much is rotting for lack of storage.
Raila also tabled a list of IEBC officials he says received Sh50 million "chicken" — code for bribes — from UK printing firm Smith & Ouzman but whose names were not included in the EACC "shame" dossier.
He named IEBC boss Issac Hassan, suspended Energy CS Davis Chirchir, former electoral commission CEO James Oswago, former Registrar of the Judiciary Gladys Shollei, as well as commissioners Kennedy Nyaundi and Kenneth Karani.
EACC rebutted the allegations.
“The list of shame and available documents indicate that while in charge of IFMIS [Integrated Financial Management Information Systems], Anne Waiguru presided over corruption. All public servants mentioned were asked to step aside. Why has Anne Waiguru remained in office and, in the words of the presidency, not under investigations?” Raila asked.
Waiguru was acting director of IFMIS in 2011 when the tender under investigation was issued.
According to the documents, Waiguru authorised payments running into hundreds of millions for consultancy services for the Oracle database used by the IFMIS system.
She signed for the initial Local Service Order worth Sh45.9 million and a further third quarter payment of Sh11.4 million to Copy Cat.
“On 17-5-2012, she authorised payments for the provision of consultancy services supporting IFMIS to the tune of Sh55.3 million. A fortnight later on 29-5-2012, she authorised a payment of Sh33.3 million for the purchase of Oracle Hardware for upgrade of the IFMIS Server,” Raila said.
Raila also tabled a letter from Treasury PS Kamau Thugge dated May 7, 2015, warning Waiguru against incurring expenditure without prior approval.
This was after she requested Sh5 billion for programmes that had not been planned by the ministry.
“Going forward, we reiterate it’s a violation of the Public Finance Management Act, Section 197(1)(h) which states that “it's an offence of financial misconduct (if) without lawful authority, an officer incurs expenditure or makes commitment on behalf of the government since this results in pending bill,” the Treasury letter said.
Raila and his Cord brigade have insisted Waiguru must step aside, as have other official, to allow for investigations.
Yesterday, Raila assailed State House, saying it was unwilling to touch Hassan and his team because they rigged elections in their favour in 2013.
The former PM said: "Your guess is as good as mine on why the IEBC officials have to be protected. They delivered for Jubilee.”
However, yesterday EACC deputy CEO Michael Mubea said: "I want to confirm to this nation that [the claims by opposition leader Raila Odinga] are not true. The list that the EACC handed over to President Kenyatta was not doctored by anybody. We are an independent commission. We do not take instructions from any individual or institution. We do not act on instructions from any quarter. Anne Waiguru was not in our list. In any case, the claims of corruption at NYS have come up long after we handed over our list. Neither was Isaack Hassan in our list. We are still investigating the 'chicken' scandal and whoever we find culpable we shall prosecute."
IEBC communications manager Tabitha Mutemi said: "Hassan's name could not have been in the list — let alone be removed — because investigations by the EACC are still ongoing. The claims by the opposition leader are not true."
