CJ Mutunga in a new push to have 15,000 pending cases heard

Chief Justice Willy Mutunga has initiated a program that will bring to an end over 15,000 pending cases in the high court.

The Law Society of Kenya held a meeting with judiciary officials this week to agree on how to speed up the hearing and conclusion of cases that have been in the court system for more than 10 years.

Registrars have issued formal notices to litigants of pending cases at the civil divisions of the High Court in Nairobi.

Similar notices are expected to be issued to Githunguri, Embu and Meru.

They were notified that their matters will be dealt with in the next three weeks.

The cases will be heard on priority basis by 15 judges selected by the CJ. The judges will give directions, including fixing hearing dates, and dismiss matters that no longer need to be in court on February 23.

This initiative is due to a huge backlog of cases in the courts.

The Case Audit and Institutional Survey of 2014 which is a comprehensive study of the backlog of cases within the judiciary found over 34,000 cases that have been in the court system for more than 10 years.

The survey aims to ensure constitutional rights of the public are not violated by the delay of land matters in the courts.

Through the initiative, the large number of cases will be heard, determined and settled at the Milimani, Githunguri, Meru and Embu law courts.

All cases in which no action has been taken for the past two weeks will be mentioned before the judge and magistrate for hearing dates and dismissal.

The second phase of the initiative will be on land ,family, commercial, criminal cases and judiciary review.

This will focus on, constitutional division of the high court of Milimani, Kisii, Mombasa, Nakuru, Gatundu Eldoret, Kakamega and Nyeri law courts.
