Impeached Kisumu county assembly speaker Onyango Oloo has disputed his removal saying the process was illegal and unprocedural. 

In a recorded interview with a radio station on Friday morning, Oloo maintained that he is still the speaker.

He was impeached on Wednesday after acting speaker Elisha Oraro said the motion moved by Joachim Oketch (Kondele ward) met the required threshold and 42 members voted in its favour. 

One of the MCAs told the Star that Oloo had been served with the notice but failed to appear in the assembly in the afternoon to defend himself.

Oloo dismissed the claims during the interview. He said that he was barred from accessing the chambers and his offices as police hurled teargas canisters at him and MCAs who accompanied him. 

In the impeachment motion, the MCAs cited an active corruption investigation at the Lake Basin Development Authority against the speaker.

They said the honourable thing to do to retain the dignity of the office of the speaker was for him to resign until the probe is completed.

But Oloo said there are many other leaders including governors and even MPs who have active cases in court and are still serving the people.

He questioned how the mall case was related to his position as the assembly speaker saying he was innocent until proven guilty.

He added that there was no court order barring him from accessing his office and discharging his duties. 

Oloo had vowed to strongly defend his innocence and his position before the MCAs took the action. 

He said his replacement with the Kisumu North MCA was illegal "as there is no provision in the law allowing the members to elect an acting speaker".

He further claimed that the approved budget risks being challenged in court as it was not signed by a substantive speaker.
