Ex-lawmaker sues Tigania West MP for defamation

Karithi says Mutunga accused him of misappropriating funds for a water project

Former Tigania West MP David Karithi has sued Tigania East MP John Mutunga for defamation.

Karithi sued Mutunga over remarks he made on a vernacular TV.

Karithi through his lawyer Marius Maranya said Mutunga accused him of misappropriation of funds meant for Kiingirwa water project.

The project that was initiated by the National Irrigation Board is yet to be complete.

Mutunga is the first defendant while Weru TV is the second defendant.

The counsel for the plaintiff is Marius Maranya, Carl Peters Mbaabu represented the first defendant while Peter Kaimba represented Weru TV.

On Monday, businessman Joshua Njerema, a witness,  told court that on October 10, 2019 Mutunga while at the Kiingirwa Water Project, accused the former MP of misappropriation of funds meant for the project.

“I called the former legislator and asked him if the allegations were true. He was shocked and said they were false. I also shared the clip,” he said.

The plaintiff's counsel wanted the clip that was in vernacular language played in court as evidence but the first and second defendants objected.

“The clip is in Tigania while the court uses English and Kiswahili,” Mbaabu said.

The former MP's lawyer said section 106 of the evidence act does not state in which language the clip tabled as evidence ought to be.

Court ruled the clip to be played. Case will proceed on May 10 this year.
