Arrest warrant against MP Mungatana issued

A warrant of arrest has been issued against Garsen MP Danson Mungatana in a case he is accused of issuing three bouncing cheques for Sh2.1 million.

The warrant comes a day after an arrest attempt was rejected after Mungatana’s lawyer claimed his client was unwell and had been admitted to hospital.

Prosecutor Samson Kiptum had successfully argued that a medical report presented by lawyer Anne Kaguri alleging thet Mungatana was admitted at Karen Hospital was incorrect.

“We have been able to confirm that the accused is not admitted at hospital. The investigating officer managed to talk to the reception and indeed found he was not admitted,” said Kiptum.

“This has confirmed my fears that what was produced was an after-thought, purely to delay the proceedings. Furthermore, the legislature was seen addressing various meetings in the media,” said the prosecutor.

Kaguri had earlier produced a medical report indicating that the MP has been hospitalised, but changed her statement after the submission by the prosecutor.

“My instruction is that the accused is under medical care and under doctors order for bed rest. He is not admitted as indicated earlier,” said Kaguri

Mention of the case was set for October 15. Mungatana is facing several cases of issuing bouncing cheques to different companies and individuals in Nairobi and Mombasa.

In the case, Mungatana is accused of issuing three different cheques each worth Sh700,000, to Chwile Investments Limited on June 20, 2011.
