Women accused of conspiracy to defraud released on Sh1m bond

Two women were on Monday released on a bond of Sh1 million with a surety of a similar amount after being charged with conspiracy to defraud.

Rose Wairimu Ngatia and Esther Njambi Odhiambo were charged before Milimani Chief Magistrate Susan Shitubi, with having conspired with the intent to defraud and obtain Sh1,130,000 from Grace Wamboi Mukuha.

It is alleged that they got the amount by falsely pretending that they were in a position to execute a court order.

The offence is said to have been committed between January 15, and February 3, 2024.

Additionally, Odhiambo faced a separate charge of obtaining money by false pretences from the same victim under similar circumstances.

"Esther Njambi Odhiambo on the diverse dates between January 15, and January 18, 2024, at an unknown place in the Republic of Kenya, with the intent to defraud obtained Sh870,000 from Grace Wamboi Mukuha by falsely pretending that you were in a position to execute a court order a fact you knew to be false," the charge sheet presented in court reads.

Both defendants pleaded not guilty and sought lenient cash bail or bond terms.

Their defense counsel emphasized that the disputed amount had been remitted to the agent involved, a fact to be addressed during the trial.

"The court should take note of that even though it will be argued during the hearing," defense counsel stated.

The state was not opposed to the application and upon determination, Shitubi granted them release on a bond of Sh1 million each with a surety of similar amount.

Alternatively, they were offered cash bail of Sh500,000 each, with two contact persons required.

The case is scheduled for mention on April 2, 2024.
