Itumbi faults DPP for charging Pauline with cyber harassment

Digital Strategist Dennis Itumbi has disagreed with the Office of the Director of Public Prosecution on the Cyber harassment accusations filed against blogger Pauline Njoroge.

Taking to his Twitter account, Itumbi defended Pauline, saying that one can be allowed to publish wrong information on social media and in the event one publishes fake news, it shouldn't end in arrests. 

"Publishing on mainstream and on Social Media includes the right to make mistakes, to get it WRONG. On Social media, Fake News cannot be cured by arresting anyone. The best way is to fact-check them and state the right position," Itumbi said.

Itumbi, a close ally of President William Ruto, deferred with the state saying that the right to insult is part of free speech and that it has been upheld in various civilisations. 

"On this one, with utmost respect to the office of the DPP, I disagree. Ati cyber harassment - President William Samoei Ruto is not someone you can harass on Social Media," he stated. 

He said that he had also been arrested and charged with the same offence four times calling for the release of Pauline and the dropping of all charges. 

"Haiwezekani! Nooo.  This, I disagree I have been arrested and charged 4 times on this petty law and won. It is simply not the way to go. Apana! Free Pauline Njoroge and if you can drop these charges."

Itumbi said that he had chosen not to comment on the matter until he came across the charge sheet.

"I chose silence till I saw the charge sheet!" Itumbi said.

According to a charge sheet released on Monday, Pauline is being charged with 'False publication contrary to Section (22) (1) (b) (d) The Computer Misuse and Cybercrimes Act No. 5 of 2018.'
