The court has extended orders barring the DCI from summoning lawyer Danstan Omari over the Matiang'i raid issue

Justice Hedwig Ong’udi extended the orders she issued two weeks ago after Omari challenged the summons on grounds that the information sought was client advocate privilege.

The LSK who are interested parties in the matter have been allowed to file their replying affidavit in support of the petition by Omari

LSK says they support the application filed by Omari.

The state has also raised issues with Omari filing two separate cases of the same nature before the court.

The first case was filed at the judicial review division and orders were issued and the second case was filed at the constitutional division which also has orders.

However, lawyer Shadrack Wambui for Omari said the cases are very different as one questions the process and the other one addresses the fundamental threat to freedom.

Justice Ong’udi directed the state to raise the issue before Justice Jairus Ngaah because she did not have the said proceedings.

The case will be mentioned on April 18.
