FAKE: Moja Expressway doesn’t fine users for exceeding speed limit

A tweet by an X user alleging that Moja Expressway fines motorists who exceed the speed limits is fake.

The user also said if one has an Electronic Toll Collection (ETC) device, they should check the deductions on their regular exit points.

“Moja Expressway fines motorists who exceed the speed limits. If you have the ETC device check what they deduct on your regular exit points,” he tweeted.

In a rejoinder, Moja Expressway Company stamped the tweet as fake.

“Moja Expressway Company does not fine users for speeding. Kindly note that the speed limit is 80km/hr.”

The Moja Expressway Company is mandated to manage the Nairobi Expressway which was officially commissioned by Former President Uhuru Kenyatta in July 2022.

Upon inquiring from Moja Expressway Company through a phone call on what happens to those who exceed the speed limit, they noted that Moja Expressway runs activities like collecting toll fees but matters of fining road offenders are solely for Traffic police officers.

Traffic Police initiate road safety sensitization to the members of the public among other duties.

On how Traffic Police handle traffic offences committed along the expressway, especially in an event where a person violates the speed limit, head of traffic operations in Nairobi Vitalis Otieno said most of the time the person would be charged, and after that he will be compelled to go to court.

The Head of Public Relations at Moja Expressway Jeanne Ongiyo is quoted by Nation saying that there are speed cameras along various points of the expressway which are operated by the traffic police.

They measure the speed limit of the vehicles on the expressway together with the number plate.

The information is sent to the traffic command centre then the traffic police along the expressway will administer a punishment they deem fit either a verbal warning or a fine. 

On a phone call with The Star, Ms Ongiyo said that the Nairobi Expressway is subject to the Kenya Traffic Act which states that those who exceed the speed limits stipulated on the Kenyan roads should be fined. 

“Our work stops at making sure that the road is maintained and collecting toll fees. But when it comes to traffic offences, we work with the Kenya Traffic Police. The traffic police then decide whether they will fine or take you to court. The expressway is still a road within the Kenyan territory meaning that the Traffic Act applies even on the expressway,” Ms Ongiyo told The Star.  

In June 2022, the National government said it would roll out measures to tame speeding along the Nairobi Expressway.

The move followed a road accident involving multiple cars and injured people at the Mlolongo toll station.

Some fines were introduced for motorists who damage property on the expressway.
