A man was on Wednesday jailed for ten years after he was found guilty of attempted rape in Yatta, Machakos County.
Mutuku Muindi, alias Mutuku wa Makombola, was also slapped with additional three years and two years in prison for assault and theft respectively after he was found guilty by the Kithimani Law Courts in Yatta subcounty on Wednesday.
Magistrate Paul Matanda Weshuli in his ruling ordered that the convict serves 15 years in jail after he was found guilty all three offences.
The sentences will run concurrently.
In the first count, the court heard that Muindi was charged with attempted rape contrary to Section 4 of the Sexual Offences Act No 3 of 2006.
The particulars of the offence were that on October 27, 2023, at Kwa Kitema village in Yatta subcounty within Machakos County, Muindi intentionally and unlawfully attempted to cause his private part penetrate the complainant's without her consent.
He was arrested on October 31, 2023, and arraigned in Kithimani Law Courts on November 1, 2023.
In the second count, the suspect was charged with assault by occassioning actual bodily harm to the complainant contrary to Section 251 of the penal code.
In the third count, Muindi was charged with stealing contrary to section 268 as read with section 275 of the penal code.
The particulars of the offence were that stole one mobile phone (make Itel) valued at Sh2,000 property of the complainant.
The suspect had been in custody since his arrest.
Three witnesses testified against the suspect.
