Brian Mwenda Njagi has been ordered to present himself at the Muthaiga police station by today noon following an arrest warrant that had been issued against him by the Makadara Law courts.

Mwenda has been accused of impersonating a High Court advocate.

High Court Judge Nixon Sifuna declined to set aside the warrant and directed Mwenda to present himself to the Muthaiga OCS by 12.30 pm for purposes of being arrested and later be presented in court on Wednesday for plea taking.

A warrant had been issued by the Makadara law courts after Mwenda allegedly failed to appear in court for plea-taking.

He was to be charged with acting as an advocate.

It is alleged that Mwenda "not being a person qualified as an advocate, appeared in court and represented a suspect in a criminal matter in September last year at the Makadara Law courts" But he allegedly failed never to appear for plea taking.

A warrant was subsequently issued.

He then moved to the High Court seeking to lift the warrant.

He claimed in his application that he suffered a panic attack while in court at the moment.

But the judge in dismissing his application said the warrant was not issued in Mwenda's presence at the time his file was called for plea-taking.

"Had it been issued while the accused was in the dock, I would have held it to have been issued improperly and would have set it aside. But in this case, the said warrant was duly issued," the Judge said.

The Judge took note of Mwenda's circumstances under which he allegedly varnished from the courtroom while the file was called for plea-taking.

"I find the manner in which he hurriedly and dramatically left the court precincts is suspect and bordering on a pre-meditated scheme that this court will neither support nor sanitize," the Judge said.

The Judge in ordering Mwenda to present himself at Muthaiga said if he fails to do so, then any police officer and any member of the public finding him be at liberty to arrest him and present him to the nearest police station.
