Nairobi chief jailed for two years for receiving Sh2,000 bribe

A Muthurwa Assistant chief who was found guilty of receiving a Sh2,000 bribe to allow a trader to do business without a licence has been sentenced to two years in jail.

Alexander Kinoti Matiiri was alternatively fined Sh100,000 to secure his release. 

While sentencing the accused on Tuesday, Anti-corruption Senior Principal Magistrate Peter Ooko said the prosecution had proved their case against Kinoti in count two.

He however acquitted him and his co-accused Justus Njoroge, a village elder of count one and three.

Ooko said that Kinoti while serving as an assistant chief, abused his position as a public servant.

"Having convicted the accused person on count two of receiving a Sh2,000 bribe, I hereby sentence him to two years in jail or pay a fine of Sh100,000", the magistrate ruled.

The court also barred him from holding any public office.

Ooko further said the judgment would be made available to the minister for the interior.

In the case, Kinoti was charged with a first count that being a person employed by public service as an assistant chief 2, requested a bribe of Sh5,000 from Linah Ngereza Asiyo.

The prosecution said he did that with intent in consequences, he would allow her to operate a wines and spirit shop at Muthurwa market without a licence.

He is said to have committed the offence on January 25, 2021, at Muthurwa sub-county in Nairobi.

Kinoti faced a second count of receiving a bribe of Sh2,000 from Ngereza to allow her to operate a wines and spirits shop without a licence on the same dates and place.

The court heard Kinoti and Justus Njoroge Hosea, a village elder, jointly agreed to receive a bribe of Sh1,800 from Ngereza with the intent to allow her to operate her wines and spirit business without a license on January 26, 2021.
