Nyachae's Sh2 billion estate case adjourned

The case was coming up for hearing today but the judge was held up in other meetings

The High Court has adjourned the hearing of Simeon Nyachae’s case where a woman has contested his will seeking a share of his Sh2 billion estate.

The case was coming up for hearing today but the judge was held up in other meetings and came to court a few minutes to 5pm so he adjourned it.

In the case, US-based woman Margaret Chewya, sued the Nyachae family for leaving her out of the inheritance, saying she was a wife and had three children for him.

Lawyers Danstan Omari and George Muchiri representing the US family and Kenyan family respectively did not object to the adjournment but asked court to give them a nearer date.

Those present in court today were Charles Nyachae and Margaret’s son Roney Chweya who says he is also a son.

Last week, one of the Nyachae’s sons Leon, filed a private investigator's report in court which said Margaret had four husbands.

The report had names of all the alleged men she was married to and some even claimed that they had children with her.

All these was in a bid to show the court that the woman who is laying a claim to their father’s wealth was not to be trusted and believed.

The family has asked court to dismiss her application saying she was never a wife and should not be recognised as one.

However, in her response Margaret rubbished the claims she was married by four other men insisting she was only married to Nyachae.

She said she is Nyachae’s fourth wife and he even paid dowry for her, further saying she was willing to take a lie detector test to confirm her claims.

She says Nyachae paid her dowry to her late uncle in 1970 and all her three children who are senior to Leon are his children.

She has asked the court to conduct a DNA test on all the three children to ascertain and confirm that.

Speaking to our reporter separately from the court proceedings, Roney who flew in from the US for the first time said it's not about the money but his father’s name.

He said he loved his step brother Charles and all the other siblings and it was unfortunate the turn of events as had been.
